I was arrested in Suffolk County for a DWI. Can they take my car?
If it is your first alcohol related arrest, the police will not seize or keep your vehicle. However, in some cases, yes, they can seize and keep your vehicle. If there are serious aggravating factors, the police may seize your car as part of an investigation. You may obtain the vehicle when the case is completed. In Suffolk County, there is a local law that permits the County to seize your vehicle if this is your second or more DWI arrest. This may apply even if it is not your vehicle. You are entitled to a hearing before a judge before the County can seize your car.
